Arizona Visitors DUI Arrest Information

As with many holidays and special events throughout the year, during the Big Game, police departments throughout Arizona dramatically increase the presence of DUI Task Forces on the street in an effort to keep the roads safe from drunk drivers. Checkpoints and saturation patrols set up during holidays, special events and sports competitions stop thousands of suspected DUI offenders each year. During last year’s Big Game, a Southern Arizona DUI Task Force stopped 544 cars for suspected DUI at one single checkpoint.

How to avoid a DUI when visiting Arizona

The increased presence of police officers looking for DUI suspects make it a good idea to have a designated driver or keep an eye on how much you are consuming if you are going to be at the Big Game in Phoenix drinking or drinking while you watch the game at a party. Even if you do not feel intoxicated, your blood alcohol content (BAC) may still be at or above the legal limit of 0.08 percent BAC, which can land you in jail.

If you know that you are going to be drinking during the Big Game and need transportation there are several options for you to explore that are available throughout Arizona.

If you drink and drive during Big Game weekend, contact a DUI defense attorney at our firm as soon as you can so that we can start working on your case.

Tough Arizona DUI Laws, Charges and Penalties

As many residents of Arizona already know, the DUI laws governing the state are some of the harshest in the country. The steep penalties and serious charges that can accompany a DUI arrest in Arizona can be an unpleasant surprise to out-of-state visitors from areas with less stringent DUI laws. The severe consequences that can result from a DUI conviction in Arizona are why out-of-state visitors charged with DUI after the Big Game need to choose an Arizona DUI attorney, rather than a lawyer from his or her home state. An Arizona DUI defense attorney will have the most thorough knowledge of the state’s DUI laws and will know the best way to negotiate reduced penalties for DUI charges and could possibly get your case dismissed.

DUI Offenses

DUI Charges

DUI charges in Arizona typically result in steeper penalties than in other states. It is important to retain expert legal representation to protect you from the serious legal consequences you could face.

First DUI Offense

In Arizona your first offense DUI conviction with a BAC at or above 0.08% and lower then 0.15% can result in 1 day to 6 months of jail time, with fines costing up to $2,500.

Second DUI Offense

If you are convicted for your second DUI offense within five years with a BAC at or above 0.08% and below 0.15%, fines may cost you up to $2,500 and you may have to spend 30 days to 6 months in jail. If your BAC is above 0.15%, the minimum jail sentence is raised to 60 days.

Felony DUI

Being arrested for DUI while driving on a suspended license, a third DUI offense within 7 years (even if the previous convictions was in another state other than Arizona), and DUI with a child under 15-years-old in the car are all felonies under Arizona DUI law. A felony DUI conviction could result in 4 months to 3 years in jail, and a second felony DUI conviction may land you in prison for between 8 months and 6 years. Fines can also cost up to $150,000 for each felony DUI conviction.

Extreme DUI

If your BAC is tested to be above 0.15%, under Arizona DUI law you are charged with Extreme DUI, which carries enhanced punishments beyond those issued for a regular DUI charge. An Extreme DUI conviction could result in 30 days to 6 months in jail.
